Abstract

This research examines the legal systems for the compulsory acquisition of land (CAL) inViet Nam, emphasizing the procedure and the relevant compensation arrangements. Based on the nature of the compulsory acquisition process, where individual properties are required for public purposes, the law is analysed throughout this research in terms of looking for ?a balance between public needs and private interests?. How this balance is struck, both in law and practice. The themes chosen and defended in this research are: the extent of the existence of settled laws defining legal interests in property; the existence of settled and fair procedures for acquiring land compulsorily, and fair compensation for land compulsorily acquired where necessary, which enable a balance to be struck between individual and public interests.

Tóm tắt

Đề tài nghiên cứu hệ thống pháp luật về đền bù và giải phóng mặt bằng ở Việt Nam, nhấn mạnh đến hai nội dung chính là ?trình tự thủ tục? và ?đền bù?. Dựa trên bản chất của quy trình giải phóng mặt bằng, các quy định pháp luật được phân tích theo chủ đề ?cân bằng lợi ích giữa nhà nước và lợi ích người dân?; làm sao để sự cân bằng các lợi ích này được thiết lập cả trong lý luận và thực tiễn. Theo đó, nghiên cứu xoay quanh các chủ đề là: xác định tài sản chịu ảnh hưởng trong quá trình giải phóng mặt bằng; xác định các trình tự thủ tục thực hiện; xác định mức độ đền bù để có thể cân bằng giữa các lợi ích trong giải phóng mặt bằng.
